This cause is before the Court upon Defendant Plum Park II, LLC’s (“Defendant” “Plum Park”) Motion to Dismiss Plaintiffs Complaint.1 (DE 8.) Plaintiff Daniel Lugo (“Plaintiff’) responded to the motion. (DE 11). No reply memorandum was filed.
