The plaintiff, as assignee of the firm of Otto Pleinze & Co., brought this action of conversion against the defendant as agent of the shareholders of the National Bank of North America to wind up the affairs of the hank. The complaint alleged that the firm of Otto Heiuze & Co. on or about October 14, 1907, entered into an agreement with the Bank of North America, whereby the bank agreed to loan them $126,000, and that they deposited with the hank certain securities as collateral; that the hank failed to make the loan or any part thereof and dishonored the firm’s check…
