In Vázquez-Valentín v. Santiago-Díaz, 385 F.3d 23 (1st Cir.2004) (Vázquez I), we reversed a jury’s verdict that Diana Vázquez-Valentín (Vázquez) had been subjected to political discrimination by her former employers, the municipality of Toa Baja and its mayor and human resources director. We reviewed the denial of the defendants’ Rule 50(a) motion for judgment as a matter of law based on the sufficiency of the evidence, despite the defendants’ failure to preserve that ground of appeal pursuant to Fed.
