CARRAND, Circuit Judge.
The Rand Company, as plaintiff, brought this action against the Butlers as defendants, to recover damages for the breach of a contract for the sale of land. The complaint contained five causes of action. The first cause of action was for money expended in attempting to remove, at defendants’ request, certain defects in the so-called Canadian lands which were to be deeded to plaintiff in part payment of the lands agreed to be sold to the defendants.
