ALLEN, Circuit Judge.

These consolidated appeals attack a judgment of the District Court in an action filed by Panhandle Eastern Pipe Line Company, hereinafter called “Panhandle,” against Michigan Consolidated Gas Company, hereinafter called “Consolidated.” Panhandle is a producer of natural gas which operates a pipe line system from Texas to Michigan, and Consolidated is a utility distributing natural gas in Detroit and the Detroit metropolitan area, and Western Michigan.
