CROSS, Judge.
This action arises from a used car sales transaction. Plaintiff, the purchaser, claims entitlement to damages, actual and punitive, *220by reason of alleged fraudulent representations made by defendant Higgins, an employee of defendant National Bond Finance Company, the seller, as to the total traveled mileage of the automobile. The defendant company has filed a counter action to recover on a delinquent chattel mortgage note executed by plaintiff in the transaction, and to recover possession of the automobile.
