This is an action of trespass to try title and for partition of an undivided one-half interest in a league of land lying in ¡Navarro county, wherein this suit was instituted, by the appellant Thomas Henderson against Alexander Beaton, one of the appellees.' The original petition was filed September 26,1870. By an amended petition, filed December 6, 1870, G. A. Sessions, guardian of Catherine Carter, a minor, W. S. A.
