The Ft. Worth Improvement District No. 1 of Tarrant county, a private corporation, organized for the purpose of constructing a levee intended to prevent overflows of a certain district by the waters of Trinity river, instituted this suit against J. S. H. Weatherred, E. W. Yeates, and James Harrison to condemn certain lands upon which to construct such levee. The lands sought to be condemned were owned, respectively, by Weatherred and Yeates, and Harrison held outstanding vendor’s lien notes against them.
