Plaintiff sued to 'recover damages for the death of her husband, Muntford J. Shore, alleged to have been caused by the negligence of defendant. She *285prevailed in the trial court. At the time of his death, October 25th, 1902, Shore was in the service of defendant at work upon an iron viaduct in process of construction on Allen avenue in Kansas City. He belonged to a crew consisting of himself and two other workmen engaged in riveting bolts.
