I. INTRODUCTION

This action arises out of the filing of an Abbreviated New Drug Application (“ANDA”)1 by defendant Barr Laboratories, Inc. (“Barr”) on March 26, 2009 for a generic version of Lumigan® (bimatoprost ophthalmic solution), used for the treatment of high eye pressure, also called intraocular pressure (“IOP”), in people with glaucoma or ocular hypertension.
