The plaintiff brought this action to recover from defendant, a municipal corporation, taxes alleged to have been wrongfully and illegally coerced by defendant from plaintiff. At the trial, had before the court sitting as a jury, the following facts were agreed upon.
“1. That on the 16th day of June, 1882, the defendant enlarged its corporate territorial boundaries so as to include the residence of the plaintiff, and that until that day plaintiff did not reside within the territorial limits of the defendant.
