The defendant appeals from a judgment of conviction, in the form of a certificate filed pursuant to section 903 of the Code of Criminal Procedure, declaring him a disorderly person within the meaning of subdivision 1 of section 899.

The same appeal was before this court on a former occasion, but I then committed the error of attempting to decide it upon what the Court of Appeals later determined was an insufficient record.
