In a class action to recover damages for allegedly illegal processing fees charged on the plaintiffs’ mortgage loan applications, the defendants appeal from an order of the Supreme Court, Nassau County (Joseph, J.), dated October 31, 2001, which denied their motion for summary judgment dismissing the complaint.
