Charles C. Stillman, defendant below, a tuck pointer by trade, was convicted of abortion and sentenced to three years in the penitentiary. The state’s evidence was such that the jury reasonably could have found that on November 3, 1955, Betty Maibes went to defendant’s home where defendant advised her to take certain medicine and used instruments and other devices upon her with the intent to produce a miscarriage, which was unnecessary to preserve her life or the life of an unborn child and which had not been advised as necessary by a duly-licensed physician.
