Defendant moves in the nature of a writ of coram nobis for an order vacating a life sentence as a fourth offender, which was imposed in this court after a conviction upon trial for robbery in the first degree on May 25, 1921. The indictment charging him as a fourth offender having been transferred from the Kings County Court for trial here, the verdict of the jury in accordance with the practice then prevalent, in addition to finding him guilty of robbery, found him to be a fourth offender.
