On April 14, 1995, the defendant, Todd P. Johnson, was stopped and arrested on Scottsville Road (Route 383) in the Town of Chili, Monroe County, New York, for two traffic infractions, failure to maintain lane and speeding, in violation *905of section 1128 (a) and section 1180 (d) of the Vehicle and Traffic Law, by Monroe County Sheriff’s Deputy Lance Hine. The defendant was also arrested for two counts of driving while intoxicated, under section 1192 (2) and (3) of the Vehicle and Traffic Law.
