The plaintiff below recovered a verdict and judgment against the corporate defendant and one James Marbury for the sum of $7,000 damages for personal injuries sus*273tained by the plaintiff in consequence of the alleged negligence of the defendants.
The gravamen of the action as alleged in the declaration is that the defendant in error, Bohan, was injured on the 21st of December, 1901, in a wreck caused by the escape of a freight train down Baker’s hill.
