LEAHY, Senior District Judge.
This is a patent infringement suit. The patent (2,441,091) was held valid and infringed (Claims 12 and 24). D.C. Del., 133 F.Supp. 648. The judgment was affirmed (per Biggs, C. J.), 3 Cir., 237 F.2d 594. The trial judge then appointed Irving Morris, Esq., a Master “to take and report an account of such damages” suffered by plaintiff (Philips) by reason of defendant’s (Drew’s) infringement. The Master’s report is confined to damages. Both sides have filed exceptions to his report.
