This is an appeal from an order of the district court of Marshall county sustaining a demurrer to plaintiff in error’s amended petition. The parties will hereafter be referred to as plaintiff and defendant, respectively.

Plaintiff, a resident of Texas, brought this action in an effort to recover for money advanced and services rendered to one Lem Elbert Combee.
