This proceeding was commenced by the plaintiff in error by filing with the board of county commissioners of Bryan county a claim in the nature of a petition duly sworn to, to recover from the county certain money, alleged to have been paid by different members of the Choctaw and Chickasaw Tribes of Indians as taxes upon certain lands belonging to the various Indians, which lands were not subject to taxation.
