Plaintiff, as receiver of the Drovers’ National Bank, seeks to recover against tbe defendant upon an assessment made by tbe Comptroller of tbe Currency against the stockholders of tbe said bank. Defendant demurs to the plaintiff’s declaration and tbe additional count thereof; the only question presented arising with reference to tbe second and additional counts.
