TJOFLAT, Circuit Judge:
This case is before this court for the third time. In the first appeal, which challenged an injunction entered to enforce a federal regulation against one of the defendants, a panel of this court, while retaining jurisdiction, remanded the case with the instruction that the district court resolve two questions of fact. The district court did as instructed, and the case was returned to the panel. The panel then found that the injunction was premature and dismissed the appeal as moot.
