People v. Moore
Michigan Court of Appeals
1Opinion of the CourtMcGregor, J.
Defendant was originally charged with second-degree murder, MCLA 750.317; MSA 28.549, but pled guilty before the circuit court on October 31, 1973, to a negotiated plea of the offense of manslaughter, MCLA 750.321; MSA 28.553. On December 12, 1973, defendant was sentenced to serve a term of 10 to 15 years in the Detroit House of Corrections.
Defendant appeals, contending, first, that the trial court committed reversible error by allegedly refusing to permit the defendant to examine the presentence report at the sentencing, and, second, that there was no factual basis for the guilty plea.
