Plaintiff, J.G.B. Enterprises, Inc., a subcontractor under two government contracts, brought this action seeking payment for goods it furnished pursuant to its contracts with the insolvent prime contractor, Capital City Pipes, Inc. (“Capital City”). Plaintiff alleges that it was a third-party beneficiary of the prime contracts and that, therefore, it is entitled to recover directly against defendant.
