1. In this case there are three bills of exceptions. The first we shall deal with is the cross-bill of the defendant in error, in which he excepts to the overruling of his motion to dismiss the motion for a new trial. It appears from the statement of. facts that the case was tried and the verdict rendered on February 5th, 1891, during the Januarv adjourned term of Haralson superior court. On February 7th, 1891, the adjourned term was again adjourned, the court ordering that it stand adjourned until May 4th, 1891, and then remain in session two weeks unless sooner adjourned,…
