The plaintiff in this civil lawsuit, the American Federation of Government Employees, AFL-CIO, Local 3669 (the “Union”), seeks reversal of a decision issued by the Under Secretary for Health of the Department of Veterans Affairs (the “Under Secretary”) on behalf of the Secretary of Veterans Affairs (the “Secretary”) pursuant to the Administrative Procedure Act (“APA”), 5 U.S.C. § 702 (2006).
