This case was referred to Magistrate Judge Leslie G. Foschio, -pursuant to 28 U.S.C. § 636(b)(1)(A), on October 19, 2005. Oh November 23, 2005, defendant filed a motion seeking dismissal of Counts 1 and 2 of the Second Superseding Indictment. On March 1, 2006, Magistrate Judge Foschio filed a Report and Recommendation, recommending that defendant’s motion should be denied.
