I,In this workers’ compensation case, Plaintiffs, the dependent children of a deceased employee, appeal the grant of a motion for summary judgment filed by the employer, Crawfish Town USA, Inc¡, and its insurer, LUBA Workers’ Compensation. Plaintiffs filed a claim against these Defendants for death benefits alleging the employee’s death was caused by an overdose of medication prescribed as a result of a work accident. Defendants filed a motion for summary judgment, contending that the claim was filed after the prescriptive period of one year from the employee’s death…
