The matters before the Court involve an appeal by employee, Elio Battista (“Battis-ta”) and a cross appeal by employer, Chrysler Corporation (“Chrysler”) of a decision by the Industrial Accident Board (“Board”), dismissing Battista’s Petition To Determine Compensation Due To Injured Employee, pursuant to 19 Del.C. §§ 2301 and 2304.
