ORDER OF DISMISSAL

MILES W. LORD, District Judge.

Defendant John Hawley has moved the Court to dismiss the indictment in this prosecution. Defendant is charged with failure to comply with an order of his local draft board to report for and submit to induction into the armed forces of the United States in violation of 50 U.S.C.App. Section 462.

After careful examination and review of defendant’s selective service file, the Court concludes that defendant’s motion to dismiss should be granted. Specifically, the Court finds no basis in fact for the I-A classification given defendant, pursuant to…
