Plaintiff’s decedent [decedent] was killed while working as an employee of defendant Catalytic, Inc. [Catalytic] while performing electrical work at the Delaware City Refinery of defendant Getty Oil Company [Getty]. The accident which resulted in decedent’s death occurred January 13, 1975. Suit was filed January 11, 1977. The complaint alleges that decedent’s death was the result of negligence and breach of implied warranty of fitness with respect to the design and manufacture of a tie breaker by Allis-Chalmers Corporation [Allis-Chal-mers].
