Appeal, No. 13, Oct. T., 1908, by Commonwealth of Pennsylvania, from decree of O. C. Allegheny Co., June T., 1896, No. 255, opening decree'of distribution in Estate of James Alton, deceased. Petition to open final decree of distribution and to secure restitution of money escheated to the commonwealth. The facts appear by the opinion of the Supreme Court. Error assigned was the decree of the court.

Mr. Justice Mestrezat,

James Alton, a resident of Allegheny county, died intestate April 15, 1895, possessed of an estate consisting of money. It was not then known that he left to survive him a widow or kindred. Letters of administration on his estate were granted by the register of Allegheny county to Edward Kelly, Jr., on May 15,1895. The auditor general of the commonwealth appointed F. C. McGirr, Esq., escheator of Allen’s estate on August 11, 189G, and four days thereafter McGirr presented his petition to the orphans’ court praying the court to determine whether or not an…
