The Hartford Accident & Indemnity Company as subrogee brought action against the Schutt Eealty Company for its negli gence in causing the • death of a workman whose employer was insured by Hartford. It seeks to recover workman compensation benefits paid to the workman’s family and appeals from an adverse judgment. The only question presented is whether the contributory negligence of the deceased workman is a bar to the action by the insurer.
