BRATTON, Chief Judge.
The indictment in this case containing two counts laid charges under 8 U.S. C. § 1324. The first count charged that Buck Wilcoxon transported Inocente Ortiz, an alien, into and through the State of New Mexico, the accused then and there knowing that the person being transported was an alien who had entered the United States in violation of law, and further knowing that the last entry of such alien into the United States occurred less than three years prior to the time of transportation.
