The plaintiff in error was arrested on a warrant sworn out by the defendant in error, charging him with practicing medicine. without a license, in violation of the statutes of this State. On a preliminary investigation he was discharged, and thereupon he brought suit against the defendant in error for malicious prosecution and false imprisonment. In the petition he alleges, that at the time of his arrest and incarceration in the common jail he was engaged in the “profession of healing diseases without the use of medicine, commonly and better known as a magic healer;” that he “heals the sick…
