I agree that Judge Grady should be disciplined.

I also agree with the majority that inasmuch as it declares sec. 757.025, Stats. 1981-82, unconstitutional, it ought to adopt a rule encompassing the broad public policy decision reflected in sec. 757.025.1 Although I would have preferred to submit the formulation of a rule to the Judicial Council, where public, open deliberations by representatives of the public, the bar, the legislature, and the trial and appellate bench may be held, I am satisfied that a public hearing in November after six months’ experience with the rule may be a reasonable…
