The issues presented'by this appeal are (1) whether the County Salary Act of Clay County effects an unlawful diversion of school funds; and (2) if so, can the funds so diverted be recovered.
Initiated Act No. 1 of Clay county was adopted at the general election of 1934. It is entitled “An Act to Fix the Salaries and Expenses of County Officials, and to Fix the Manner in Which Such Compensation and Salaries Shall he Paid, and to Reduce the Cost of County Government, and for Other Purposes.” The act consists of 15 sections.
