The plaintiffs Walter- H. Ostertag and wife sued the defendants for damages resulting from the construction of a street adjacent to their property it being alleged that in doing the work in question the defendants encroached on and cut away large portions of plaintiffs’ soil'along'the entire Eastern side of their lot and excavated so as to leave an almost vertióle bank along the side of plaintiffs’ property thus destroying the lateral support thereof and causing considerable quantities of earth on…
