The record discloses the following facts: On or about the 30th day of April, 1924, defendant John L. Hayes Construction Company, Inc., hereafter referred to as the Hayes Company, and the People of the State of New York, hereafter referred to as the State, entered into a written contract wherein and whereby the Hayes Company agreed to construct a concrete highway between Saugerties and Palenville, a distance of about eight and one-half miles.
