Error to judgment of corporation court of Norfolk city-in action of trespass vi eb armis, wherein A. D. Barrett is plaintiff and Euclid Borland is defendant. The opinion of the court fully states the facts and the instructions asked for and points 'raised. Verdict for plaintiff for $>1,000 damages and judgment accordingly. From this judgment defendant obtained a writ of supersedeas.

*130This was an action of trespass, assault and battery, brought in the corporation court of Norfolk city. The case was tried by jury, who rendered a verdict of $1,000 damages in favor of the plaintiff. This verdict was affirmed by the court, and judgment given against the defendant, who applied for and obtained a writ of error and supersedeas from one of the judges of this court.
In order to understand the errors relied upon to reverse this judgment, it is necessary simply to allude to some of the evidence adduced on the trial. It appears that the defendant and his wife, in the year 1878, were…
