MEMORANDUM AND ORDER
WOLF, District Judge.
I. SUMMARY
On July 15, 2003, John Gillies was indicted for conspiracy to possess with intent to distribute marijuana and possession of marijuana with intent to distribute. On August 5, 2003, a Superceding Indictment was returned which alleged that Benjamin Silver participated in Gillies’ crimes. The government subsequently obtained the cooperation of John Ryan, an unindicted co-conspirator in this case who is charged separately in another case.
