This is an action under the Workmen's Compensation Act (Rev.St. 1925, art. 8306 et seq., as amended), originally instituted before the Industrial Accident Board of the state, in which Floyd Clark alleged that on January 12, 1928, he was an employee of the Prairie Pipe Line Company, a subscriber under the Workmen's Compensation Act, and that the defendant, the Texas Indemnity Insurance Company, appellant herein, was the insurer for the said pipe line company, and that on said date the claimant, Floyd Clark, while in the course of his employment, was riding in an…
