I. Factual and Procedural Background

Slater Development Corporation (SDC) owned a parcel of real property located in Saline County, Missouri, and entered into a contract with Nick Scurra (Scurra), who was to serve as the general contractor in a commercial construction project to build a discount store known as Place’s. Mr. Coomes, a subcontractor, entered into a contract with "Scurra on February 4, 1998, to erect a steel building for Place’s.
