Defendant was convicted of the offenses of manslaughter in driving a vehicle, with gross negligence; was granted probation; and appeals.

Although contradicted in part, there is evidence showing: Defendant, while under the influence of intoxicating liquor, drove an automobile westerly along Orangethorpe Avenue, in the City of Placentia, at between 60 and 65 miles per hour. The posted speed limit was 45 miles per hour.
