MEMORANDUM OPINION AND ORDER

STORY, District Judge.

In CM Action No. 1:96-CV-1738, Plaintiff Atlanta Journal and Constitution (hereinafter referred to as “AJC”) filed a Complaint for Declaratory and Injunctive Relief. The AJC alleged Defendant City of Atlanta Department of Aviation implemented and enforced a scheme restricting newspaper vending racks at Hartsfield Atlanta International Airport which violated the First Amendment of the United States Constitution and Article I § 1, ¶ 5 of the State of Georgia Constitution.
