Summary proceedings under chapter 154 R. L. were instituted by the defendant in error herein, who was plaintiff below, in the district court of Makawao, county of Maui, for the recovery of a certain lot of land containing 51.50* acres, the same being lot 13 and a part of the premises demised by the Territory of Hawaii to the defendant, the plaintiff in error, by a general government lease dated April 24, 1911.
