MEMORANDUM AND ORDER

BELOT, District Judge.

This matter is before the court on review of a magistrate’s order. (Doc. 839). The court has previously set forth the essential facts of this dispute. 762 F.Supp. 1434, 1437-38 (per Theis, J.).

The court reviews a magistrate’s order under the terms of 28 U.S.C. § 636 and Fed.R.Civ.P. 72(a). As to nondispositive pretrial matters, the district court reviews the magistrate’s order under a “clearly erroneous or contrary to law” standard of review. Ocelot Oil Corp. v.
