Judgment, Supreme Court, Bronx County (Gerald Sheindlin, J.), rendered November 14, 1989, convicting the defendant, after a jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him, as a predicate felon, to an indeterminate prison term of from 8 to 16 years, unanimously reversed, on the law and as a matter of discretion in the interest of justice, and a new trial is ordered.
