MEMORANDUM OPINION AND ORDER

LEINENWEBER, District Judge.

This case is before the court on the Trustee’s motion to dismiss the appeal of this case from the bankruptcy court. For the reasons set forth below, the Trustee’s motion is granted.

The underlying bankruptcy proceeding is In re Central Ice Cream Company, 59 B.R. 476, which is before Judge Schmetterer. The only significant asset of Central Ice Cream Company’s estate (“Central”) is Central’s claim for breach of contract, which centers around a contract between Central and McDonald’s Corporation and McDonald’s System, Inc.
