I. INTRODUCTION

Plaintiff Moira Goletz (“plaintiff’) filed the present action on June 3, 2004 alleging claims pursuant to the Employment Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq., against The Prudential Insurance Company of America (“defendant”). (D.I. 1) She seeks recovery of long-term disability benefits allegedly due under a policy of insurance issued by defendant to her employer, clarification of her rights under the policy, and costs and attorney’s fees as provided by ERISA.
